Pre-Holiday Happenings on Sanibel


It’s been a week of wonderful, though chilly, island weather. We’ve had the heat on in the office for a few days and been wearing sweaters, while those here on vacation continue to pedal and jog by in their shorts and tee-shirts. Forecasts say that it will be back up into the 60’s by tomorrow, with temperatures expected to creep up into the high 70’s again by early next week.

Sanibel realtors logoIt was standing room only yesterday at the Association of Realtors® December Membership Meeting followed by east-end Caravan. A big crowd always comes when we have a speaker from the City of Sanibel. This year, it was Senior Planner, Roy Gibson. His short power-point covered three documents and followed with questions/answers.

  1. The Sanibel Report – An early history of the island, the Sanibel Plan is a scientific document published in 1976. It’s probably best known as an environmental assessment of Sanibel, a natural systems study, if you will. It is no longer in publication, but it provided the scientific foundation of the areas that today are known as the island ecological zones.
  2. The Sanibel Plan – Developed in 1975 (after City incorporation in late 1974), this is a living document accessible at the City website, www.mySanibel.com. It contains the vision statement for the island, describing how Sanibel is 1st a Sanctuary, 2nd a Community, and 3rd an Attraction. It provides the zoning maps and provides the regulatory framework for the City including its goals, objectives, and policies.
  3. The Sanibel Code – This is the document most often used by the Planning Department and island Realtors®. It’s the operations guide for the City. (We all got a chuckle out of Roy’s pop quiz to guess the weight of the printed document (which is 10.1 lbs). The lucky answerer got their own copy of the Code.) I have a hard-copy in my office too, but it’s much easier to read it on-line. The Sanibel Code contains the City Charter which describes how the City is governed and the Land Development Code. It’s that development code that comes into play in real estate transactions. There is a link to the Code on www.mySanibel.com.

No Realtor® Caravan next Thursday, but the every-Thursday-morning schedule begins again on Dec 28 with a West Caravan.

Conflict Over Vacation Rental Rights Brewing

Florida Realtors logoInteresting to see an article from Fort Myers Beach posted on line at FloridaRealtors®. This one on Dec 12, 2018 is credited to Laura Ruane, Journal Media Group. Sanibel already has a monthly-minimum on rental homes in residential communities.

“Homeowners have a right to live in peace, free of a steady stream of noisy interlopers, says Doris Grant, Fort Myers Beach resident.

“Government should respect owners’ rights and keep excessive laws off private property, says Joe Tekulve, an Ohio resident with a beach vacation home.

“It’s a battle of rights as some people ponder whether short-term vacation rentals should be more closely regulated, in particular by local governments.

“Two Lee County municipalities took up the matter recently. And, state lawmakers are expected to once again weigh in on short-term rental regulations in the upcoming session.

“Vacation rentals of fewer than 30 days are big business and growing: The Florida Department of Business & Professional Regulation estimates the number of state-licensed, short-term rental units grew from 117,000 in 2012 to 131,000 in 2016. That growth may be vastly understated in this era of online platforms helping hospitality rookies rent out their spare bedrooms or entire homes.

“But as Airbnb, HomeAway, VRBO and others began marketing vacation rentals in less-commercial areas, complaints poured in from year-round residents. They say their neighborhoods are suffering from a revolving door of short-term renters – guests who sometimes thoughtlessly disturb the peace and character of a place.

“Multiple issues – Bad behavior by renters isn’t the only issue. Area hoteliers and property managers say the competitive field no longer is level when owners of homes and condos can rent out the dwellings for a day or two or more – and yet can ignore health and safety measures, tax remittance and other rules without penalty.

“In 2011, the Florida Legislature adopted measures prohibiting municipalities from regulating vacation rentals – unless they already had such laws in place. Florida was still working its way out of the Great Recession, so sympathy was high for property owners trying to earn a few bucks – and perhaps even avert foreclosure.

“At the same time, though, private equity firms were buying homes in foreclosure for pennies on the dollar, and turning some of them into vacation rentals. In some areas, rentals became dominant and operated like hotels, although often poorly managed.

“In 2014, the Legislature passed a bill “giving cities back the authority to regulate vacation rentals. But they could not regulate the duration of these rentals,” said Casey Cook, senior lobbyist with Florida League of Cities. Cook’s organization favors “home rule,” meaning municipalities decide what level of regulation is right for their residents.

“Last spring, a push championed by Sen. Greg Steube in the Legislature collapsed. That bill would have pre-empted local regulation of vacation rentals – other than existing laws grandfathered-in. However, the topic is far from dead: Two Senate Community Affairs Committee workshops in October took testimony on how to best regulate short-term rentals, and who should do it.

“When contacted in early November, a staffer in Steube’s Tallahassee office wouldn’t rule out the possibility another vacation rental bill could surface next year. Florida’s Senate will convene Jan. 9.

“Numerous Florida cities – including Miami Beach, Fort Lauderdale, Boca Raton and Hollywood – have tried to address the issues surrounding short-term rentals regulation. Locally, a rentals ordinance failed to pass muster with Cape Coral City Council. The town of Fort Myers Beach is still weighing its options.

In October, Cape Coral City Council rejected a short-term rentals ordinance that would have required property registrations, a city business license, inspections and the naming of a local contact for emergency purposes. The vote came following a second public hearing at which realty companies, local landlords and Airbnb hosts spoke against the measure.

“Cape Coral’s land-use regulations already prohibit renting to guests for periods of fewer than seven days, but they are not enforced. Host Compliance Software, which monitors short-term rental host agencies, estimated the city has more than 3,100 vacation rentals. This would include an unknown number that rent by the night, contrary to city law. Analysis by the city, which compared that group of rentals with the number of state-registered Cape short-term rentals, showed more than 2,000 are not registered with the state, as required. “We have a compliance issue with thousands of illegally operating short-term rentals in Cape Coral,” said Michael Ilczyszyn, assistant city manager.”

It’s Susan reporting another beautiful Friday on the island – sunny 80 degrees. Our fall weather was short lived, but we don’t mind a bit. We had nice visits from several returning clients this week and the roadways/bike paths are indicating “they’re back!”.

More and more new events are being posted, so if you want to check the “Island Events” tab on our website (www.SanibelSusan.com), I updated it this week to include many of the upcoming fun things to do.

This week was the 2nd rehearsal of the BIG ARTS Community Chorus with the group already tuning up for the Thanksgiving Celebration (Nov 19), Sanibel Luminary (Dec 1), and our Holiday Concert (Dec 14).

At the Sanibel & Captiva Island Association of Realtors®

Yesterday was the start of the again-weekly Thursday 8:30 a.m. Realtor® Caravan meetings. During this fall/winter/spring schedule, the Caravans are limited to 15 properties and, because of the traffic, rotate property locations, with east-end properties one week, and west-end, the next. West end is from Rabbit Road to the tip of Captiva. East-end is Rabbit Road to the lighthouse.

Surprisingly, yesterday’s meeting was lightly attended, but those on-hand were receptive to our last Association benefit of the year, “Fall Into Christmas”, planned for next Wed (Nov 8) after-hours, when we kick-off the holiday season and collect unwrapped toys, gift cards, and donations for “Friends Who Care”.

Caloosahatchee and Everglades Update Post Hurricane Irma

SCCF logothe Sanibel-Captiva Conservation Foundation (SCCF) and the Everglades Foundation on Tuesday, Nov 14 at 7 p.m. at the Sanibel Community House for The Caloosahatchee and Everglades: In the Eye of the Storm. This program and community conversation will focus on water quality issues and restoration following Hurricane Irma.

Progress is being made on Everglades restoration projects critical to opening up the southern end of the Everglades to move water south. The passage of the bill to establish the Everglades Agricultural Area (EAA) reservoir will work in tandem with these projects to add water storage capacity south of Lake Okeechobee to feed needed water to the Everglades and Florida Bay currently dumped to the estuaries. The dark, excess freshwater resulting from Hurricane Irma illustrates how badly alternative outlets and additional storage are needed. On November 14, SCCF and the Everglades Foundation will highlight issues ranging from water conditions to restoration progress and how you can participate in the coming state legislative process and a Federal Action Day in Washington, DC. in May 2018.

While the EAA Reservoir does not solve all of the problems, it’s a major step forward and initial planning for the project has begun. There will be time for audience questions and you can find out how you can help. Community support and action will be vital in advancing the projects and funding needed — as Hurricane Irma’s statewide impacts will also require funding from the state. Committee work for the next Florida legislative session has already begun and the session will open on January 9 (two months earlier than normal).

The program is free and open to the public. No reservations required. Doors open at 6:30 p.m. on Tuesday, Nov 14 at the Sanibel Community House, 2173 Periwinkle Way. Refreshments will be available. Program starts at 7 p.m. Call SCCF at 472-2329 with questions.

Tax Reform Hits Homeowners

realtor logoOne of my favorite economists, Lawrence Yun, posted a good article in the November/December 2017 Realtor® magazine. Though following this topic is like following a moving train, his advice applies regardless of the political outcome.

“Renters will come out ahead, albeit temporarily, if the “Big 6” tax reform framework is passed in its current form. They stand to get about $500 in tax cuts each year. The plan was released at the end of September by the Trump administration and Republican leadership in Congress.

“Because there is no free lunch, who then will foot the bill? Homeowners. Particularly families with children. While it’s unlikely lawmakers intended to hurt them, that will be the result.

“Tax reform is a laudable goal. Lower tax rates are what people want. And Americans are fed up with the many hours it takes to comply with today’s complex code.

“But a reform at the expense of homeowners is misdirected. Homeowners already pay 80 to 90% of all federal income tax in any given year.

“The plan to double the standard deduction (from about $12,000 to $24,000 for a family) means far fewer homeowners will use the mortgage interest deduction. Some homeowners may come out ahead while others will lose out. But larger families will be faced with a particularly difficult challenge, because the personal exemption and the exemptions for dependents which are both $4,050 per individual, would go away.

“For renters, who don’t take the mortgage deduction, the higher standard deduction will likely make most of them better off. Historical data has shown that renters do not accumulate wealth over the long haul. The latest Federal Reserve data show the typical wealth of a renting household has fallen from $5,900 to $5,100 since 2010, while homeowning households have seen their wealth jump from $192,800 to $231,400.

“Congress needs to thoroughly review the tax code with an eye toward simplifying it and reducing the tax burden on Americans, particularly middle-income households who today pay a disproportionate share of our nation’s taxes. Reduced payments in a simplified system could even boost long-term GDP growth. But Congress must never forget, sustainable and successful homeownership should be encouraged.”

Almost Halloween on Sanibel


OctoberToday is another sunny day on the islands where we are excited to report cooler temperatures and low humidity. It’s always a nice change to have windows open and to wear long-sleeves again. Those local changes also indicate changes up north too, with cooler norther temps resulting in more inquiries and a boost in business here. Temperatures today were expected to reach the low 80’s before another cool front arrives tomorrow after a few showers. Then, temperatures are expected to go into the 50’s at night, with days in the 70’s.

Sanibel Update on Hurricane Irma Vegetative Debris Collection

Veg-Debris-1As of Wed, mySanibel.com reports that the “first sweep” of the island is 93.35% complete with 78.08 miles out of the 83.64 miles of roads completed. 28 streets (or a portion) out of 256 public and private roads remained to be done with two streets remaining due to sagging Comcast lines. City crews are using small vehicles to collect the debris on the roads blocked by Comcast lines.

Stump removal and a final “mop-up” collection of hurricane-generated debris will be next with hours of operation changing on Monday Nov 6.

Property owners are reminded that vegetative debris generated as part of routine maintenance is to be disposed consistent with pre-hurricane collection methods. Bagged or containerized residual debris will be collected by the regular hauler on regularly scheduled horticulture collection days.

Vegetation Trimming on Periwinkle Way

Sanibelcityseal logoNotice from City of Sanibel – “From Monday Oct 30 through Friday Nov 10 from 7 a.m. to 5 p.m., the vegetation along Periwinkle Way will be trimmed from Lighthouse Beach Park to Tarpon Bay Rd. Intermittent lane closes are expected. Drivers and pedestrians, please proceed slowly and cautiously through areas when workers are present.” 

Are Your Neighbors Trees Growing On Your Property?

henderson-franklinAnyone who knows where I live, recognizes that I like my yard neat and trimmed. Thankfully, my landscaper does a good job of keeping it that way. One of my neighbors, on-the-other-hand, prefers the jungle look. Sometimes a few of their trees, a big one in particular, grow out over my property.

Some years, during my annual fall “big trim”, I have paid dearly to have some of “their” branches cut back. This year, however, Hurricane Irma did a nice job of taking care of that task for me. Even so, the below article by Donald Thompson, posted on-line Oct 18, 2017 on the Legal Scoop Blog of Henderson Law was of interest. Maybe it applies to your situation too.

“Your neighbors are proud of their beautiful, large fruit trees, which are now growing substantially over your property. The trees have grown so large that a number of branches extend over your house, tool shed, and other improvements, which you believe results in a dangerous condition, not to mention rotten fruit dropping on your patio. What are your options: force the neighbor to remove the tree extending over your land, sue for damages, or something else? You may be surprised.

“In Florida, a possessor of land is not liable to others outside his land for nuisance caused by vegetation growing from his land over adjoining properties. Scott v McCarty, 41 So. 3d 989 (Fla.4th DCA 2010). Therefore, your neighbor has no duty to remove or even trim the tree branches that encroach onto your property.

“However, as the adjoining property owner, you have the privilege to trim back, at your expense, the offending (encroaching) tree, roots, branches, and other vegetation. Gallo v Heller, 512, So. 2d 215 (Fla.3d DCA 1987). Maybe this does not seem fair. You may wonder why you must pay to cut your neighbor’s trees that she allowed to grow over your property. The rationale appears to be grounded in common sense and public policy. Courts recognize that allowing such a claim would likely result in innumerable, and in many instances, vexatious lawsuits. In fact, one case reasoned that departing from the precedent would invite further litigation between neighbors, which as a matter of public policy should be avoided. Scott v McCarty, 41 So. 3d 989 (2010)

“Options – If your neighbor’s tree is growing onto your property, as a general rule you may trim the vegetation that extends onto your property. However, you should not cut any portion of the tree on your neighbor’s property and should not enter onto your neighbor’s property without consent. In fact, you should chat with your neighbor first and discuss what you intend to do. Even if your neighbor disagrees, and the matter ends up in a courtroom, a judge is likely to look favorably on your attempt to amicably resolve your disagreement.

“Exceptions – Of course, there are exceptions to most general rules. In Sullivan v Silver Palm Properties, Inc., 558 So. 2d 409 (Fla. 1990), the Florida Supreme Court cites at least two cases which held a landowner responsible for maintenance of trees and vegetation obstructing motorists’ view of a stop sign. The Courts reasoned that overhanging vegetation which blocks traffic control devices presents an imminent danger, and that a duty to remove vegetation obstructing critical traffic control signage is common sense. Also, the general rule in Florida of no duty or liability of a neighbor for overgrown trees is not the rule followed in all states.

“Other matters to consider before taking action may include:

  • review municipal or county ordinances, if applicable;
  • investigate and consider the possibility of removal of vegetation on your property causing damage to your neighbor’s property; and
  • use common sense.

“These types of claims can be fact driven and varying facts may affect an outcome in court. If in doubt, be sure to seek a competent attorney to assist you. Sanibel/Captiva Scoop – Labor Day Weekend 2017


It’s SanibelSusan reporting that Sanibel & Captiva have pretty much dried out from the three days of rain experienced last weekend. My street was flooded until Monday afternoon.

Local area schools and City offices were closed on Monday, due mostly to flooding in off-island areas.

But, by Tuesday through today, the weather has been sunny and mostly bright with any lingering showers inland. Reports too are that the shelling has been great!

Now we are all keeping a close eye on Hurricane Irma. The end of hurricane season can’t come soon enough for me, sure still seems like the end of Nov is a long way off.

Flooded Homes Can Be Fixed But…

“As Hurricane Harvey moves off the coastline of Texas, it’s leaving massive flooding in its wake that has destroyed homes and businesses.

“Until the floodwaters recede, cleanup efforts are mostly on hold. But remediation companies say they’re ready to jump into action as soon as they’re able. In preparation for the undertaking, here are a few important items to share about repairing a flooded home, compiled by realtor.com®.

“Time is of the essence.

A home that has been flooded does not need to be torn down, but the water does need to be removed quickly. Truck-mounted vacuums with 2,000 horsepower and dehumidifiers can extract moisture from furniture, hardwood, tile, and Sheetrock. But Robyn Kent, a claims administrator at Dalworth Restoration in Euless, Texas, says the most important element is getting it cleaned up quickly: “Closer to the three- to five-day mark is when it becomes questionable, since by then, all the materials have become fragile.”

“Mold is the real issue.

“One of the biggest problems—especially in Houston in the summer—is going to be mold,” Tyler Drew, a Los Angeles real estate professional and investor, told realtor.com®. “The longer a house sits with water, the worse the mold infestation. Affected areas have to be removed, the wood and concrete treated with anti-mold agents, and all of this has to be done after the house is sealed, in order to prevent the infestation from spreading and sickening people.”

“Repair costs can escalate.

“Drying off a 2,000-square-foot house in normal conditions may cost more than $2,500, while in situations like Harvey is producing, the job scope expands quickly—and so will costs,” says Peter Duncanson, director of operations and safety with ServiceMaster Restore. Flood insurance may cover the cost of repairs, but it depends on what type of insurance the owner has. Standard homeowner’s insurance policies don’t typically cover flooding inside a home, and many in Houston don’t have flood insurance.”

30% of Luxury Deals Are ‘Suspicious’

“A new watchdog program designed to monitor real estate deals involving shell companies has found that the buyers in 30% of high-end deals were linked to “suspicious activity,” the Treasury Department reported this week. Federal officials are now expanding the program, which aims to prevent money laundering by overseas buyers who use shell companies to mask their identities.

“The program, called the Financial Crimes Enforcement Network, focuses on major markets that attract a high volume of international buying activity, including New York, Miami, and Los Angeles. Officials this week added Honolulu to the list. The program is monitoring wire transfers of funds as well as cash deals.

““This could have a chilling effect,” Redfin chief economist Nela Richardson told CNBC. “That very high end of the market is the most vulnerable to these issues. If a lot of foreign buyers were parking their money in high-end real estate and that much of it is tainted, this rule will have an impact.”

“Under FinCEN, title insurance companies must determine the identities of shell company owners who are making cash real estate purchases at certain price points—usually more than $1 million. The Treasury Department then determines whether those shell companies have been flagged on lists of suspicious activity. FinCEN focuses on transactions worth more than $3 million in New York, $2 million in California and Hawaii, and $1 million in Florida, among other price points and locations.

““Through this advisory and other outreach to the private sector, FinCEN, [the real estate] industry, and law enforcement will be better positioned to protect the real estate markets from serving as a vehicle to launder illicit proceeds,” FinCEN acting director Jamal El-Hindi told CNBC.”

Sanibel/Captiva Real Estate on Cinco de Mayo


cinco de mayoSanibel & Captiva Islands had another week of good weather and little traffic – or at least until late yesterday when a boat slid off a trailer coming out of Sanibel Harbour onto Summerlin Road just after the toll booth going off island.

That little roadway snafu kept vehicles leaving the islands at a slow crawl until close to 7 p.m. Silly me then, doing some off-island chores after work.

The weather this week included the first major shower of the rainy season. Boy, was the rain needed when it arrived late Monday night/early Tuesday morning. Though off-island teammates Dave and Elise saw only a few drops and heard some thunder rumbles where they live, they noticed causeway flooding as they came onto the island. There were huge puddles from the east-end to Captiva. Most now have disappeared, with “greening” up already noticeable. I heard a Lee County Mosquito Control plane buzzing the east-end early morning yesterday, yet another sign that we got rain and it’s May.

The change in island occupancy is evident even to the lunch crowd. No waiting at Doc Ford’s on Tuesday when my lunch friends and I snagged a nice breezy outside table. They later sent me the below photo and said I could share it. Thank you, Susanna and Yves-Pascal, for a great visit and terrific picture too!

First Off-Season Caravan Meeting

Sanibel realtors logoAttendance was light at yesterday’s Thursday morning local Association of Realtors® Caravan meeting which had just two homes (one bank-owned) and a single condo on tour. That’s another indication that “high season” is over. Here forward, until late fall when business picks up, Caravan’s will be held every other week and open to any new listings in any location on either island.

  • Water Quality Update – During the Committee Reports, Realtor® David Schuldrenfrei for the Government & Environmental Committee reported that SB #10, regarding Everglades restoration and water storage, passed in the Florida Legislature with the House of Representatives following the lead of the Senate. This bill has been decades in the making and provides $800 million in funding to create a dynamic reservoir south of Lake Okeechobee, in the Everglades Agricultural Area. The reservoir is needed to provide freshwater to Florida Bay and to alleviate discharges to the Caloosahatchee and St Lucie Rivers. The bill now is on its way to the Governor’s desk for signature. Local Realtors®, City officials, and others have spent nearly 20 years working toward this milestone. David offered a big thank you to all involved for their continued persistence. A further update is below, on other issues in the forefront of Florida’s legislative session which wraps up today.
  • Working Together to Make a Difference – For the Communications and Public Relations Committee, I announced that Realtors® Bob and Diane Stocks joined me Monday morning in transporting to Catholic Charities of SW Florida, the gently-used clothing collected over the last two months by Association Members. That delivery was a humbling experience. Charity workers were very thankful for the carloads of goods delivered saying they are particularly in need of donations for Clewiston farm worker families, those who lost belongings in Florida’s fires, recent rescues human trafficking, as well as those down on their luck hoping and looking for jobs, to become more self-sufficient. This month, the Committee is spearheading a new campaign, collecting pillows, bed linens, and diapers which will be donated on June 1 to ACT (Abuse Counseling Treatment Center) in Fort Myers. Their needs increase in the “off season” too.
  • Real Estate Announcements – Under new and old business, a couple of old sales were announced. Listing agents are careful these days to wait until after inspection/cancellation periods are over – or contingencies are removed – to make an announcement.

Also, a “back-on-the-market” was reported where a property did not close because the buyer couldn’t get financing. That doesn’t happen here too often, but it could be because the home was found to have aluminum wiring, which can make a property difficult to insure. The listing agent announced that the wiring is being replaced and it again is available for sale.

I announced the price reduction at our Seagull Estates listing. A couple of upcoming new listings were announced too. There usually are not many new offerings this time of the year. These were the result of winter residents heading home and moving elsewhere. The details of the activity posted since last Friday in the Sanibel/Captiva Multiple Listing Service follows some other news items below.

While I was at the Thursday caravan meeting, Dave was at a property inspection. I hope he wasn’t on the roof when this picture was taken, but here is his photo showing how few were on Beachcomber’s east-end stretch of beach then.  The gulf waters are beautiful!

Update on Florida Legislative Session

Florida Realtors logoAs Florida’s legislative session comes to a close, Florida Realtors® Vice President of Public Policy, Carrie O’Rourke, emailed the members of FloridaRealtors® Think Tank (yes, I am one of those) a summary of what she said is “is shaping up to be one of our most successful sessions in recent memory.” Here are some excerpts:

  • Business Rent Tax Reduction – We are closer to success than ever before! After years of fighting for a reduction to the business rent tax we were finally able to overcome the obstacles and there is a strong chance we will come out with a win for business owners, commercial Realtors®, and ultimately, Florida’s economy. Under the current proposal, which was just passed by the Senate Appropriations Committee, the business rent tax would be reduced 0.2%, moving from 6% to a permanent 5.8%. While this may at first seem like a very modest cut, there are two things to consider
  • First, this cut represents more than $60 million fiscal impact to the state, and comprises the vast majority of the small amount of funding that was available for tax cut purposes.
  • Second, this cut represents a big step for a legislative body that has been reluctant to even open the door on a cut to this revenue source.
  • The bill now travels to the full Florida Senate for a vote, and will also need to pass the House before the legislature adjourns on Friday, the scheduled conclusion of the Legislature’s 60-day session.
  • “10% Non-Homestead Property Tax Cap – Success! The joint resolution has passed both legislative chambers and will not be heading to voters during the 2018 general election. This is a significant victory for Florida Realtors® as it gives us the time we need to conduct a comprehensive, direct-to-voter campaign that will help voters understand why they need to make this important tax break permanent.
  • “Estoppel Certificate Fee Reform – …For three years, we have been advocating for caps on unreasonable estoppel certificate fees and all that hard work has paid off with the passage of SB 398. This legislature caps the fees that community association management companies can charge for estoppel certificates at $250 for unit owners who are current in their assessments. An additional $100 can be charged for “expedited” estoppel certificates (delivered within three business days), and another $150 can be charged for owners who are delinquent in their assessments. This is a maximum of $500 for an expedited, delinquent estoppel certificate. Gone are the days of certificate fees that cost $1,000 or more….
  • “Vacation Rentals – It took about 4 hours of debate and a close vote for HB 425… to make it out of the House. This is the bill that essentially stops local governments from targeting vacation rental homes with restrictive ordinances. In other words, if a local government passes an ordinance targeted at vacation rental homes, it has to apply to all residential homes in the area; vacation rentals cannot be singled out. The original bill has been amended several times and has a tough road ahead of it in the Senate.
  • “Increase to the Non-School Homestead Exemption – The Senate passed a priority issue of the House concerning a proposed increase to the non-school homestead exemption by $25,000. Currently homeowners receive a tax exemption on the first $25,000 in the value of their properties. They pay taxes on the value between $25,000 and $50,000 and then receive an exemption on the portion from $50,000 to $75,000. The House ended up adopting the Senate’s version of the joint resolution which would apply the exemption to the portion of values between $100,000 and $125,000. This passage will place a constitutional amendment on the 2017 general election ballot.”

First Sea Turtle Nest

Turtle hatching 07-01-16As follow-up to last week’s posting about sea turtle nesting season beginning, the first nest of the season was found Saturday, April 29, near Gulfside Place condos. The nest has been staked off by volunteers from SCCF’s (Sanibel-Captiva Conservation Foundation) Sea Turtle Monitoring Program. Reports say that this year’s first nest is early, but not as early as last year when the first one was found on April 20 on Captiva.

Sea turtles on Sanibel/Captiva are coming off back-to-back record years. A new record was set in 2015 with more than 600 nests. Last season that record was beat by a mile when the two islands had a combined total of 826 nests.

SCCF volunteers patrol the beaches early every morning during nesting season, recording new nests and false crawls (when a female comes ashore but doesn’t lay eggs). The volunteers take measurements and stake the nests. In recent years, they also have covered nests with mesh to prevent coyotes from getting to them.

This week, while northern states dealt with snowy Storm Stella, Sanibel and Captiva had a little brush of winter weather too – island style. After a couple of short, though much-needed, showers, yesterday and Wednesday were chilly, with daytime temperatures not getting out of the 60’s. Today, temperatures are inching toward the low to mid-70’s, with more of the same nice weather expected over the weekend and into next week.

March Membership Meeting – Sanibel/Captiva Islands Association of Realtors®

In addition to general announcements, including 20-some price changes, several island Realtors® were recognized at the state level for achieving Florida Realtors® Honor Society status. It was nice to have some new recipients this year. Year #18 for me, dating back to 1998 when I was appointed to my first state committee. Lots of great networking and business opportunities have come from that involvement. VIP’s Jim Hall, who was my broker then, encouraged that work and has made Florida Realtors® Honor Society for more than 20 years. Congratulations to all recipients.

Community Outreach

Sanibel realtors logoAlso, a big thank you to my local Association Communication & Public Relations Committee members who met early Tuesday morning for our 3rd meeting of the year. Volunteering time “in season” always is appreciated. It is easy to be a committee chair when you have willing cooperative colleagues. Between now and April 28, the committee is spearheading a gently-used clothing drive. Items collected will be donated to charities that provide the clothing FREE to those in need of a hand-up. All types of clean Florida-type clothing are needed – womens, mens, and childrens.

If you have items to donate, they are being accepted at the Sanibel & Captiva Islands Association of Realtors® office at 2353 Periwinkle Way, Suite 201 from Monday through Friday 8:30 a.m. to 5 p.m. (That is the shopping center behind Wings, 2nd floor over Finnimore’s Cycle Shop.) Dredging Blind Pass While Renourishing Sanibel’s Beaches

“Recent heavy winds delayed the current phase of dredging Blind Pass by about a week and will likely delay completion of the project until mid-May, according to Kathy Rooker, administrator of the Captiva Erosion Prevention District. But, as anyone who has driven over the Blind Pass Bridge separating Captiva and Sanibel can’t help but notice, the project to clear the pass and use its sand to renourish Sanibel beaches is well under way.

“Nearly 3,500 feet of massive black piping stretches from a pump on a barge at the Roosevelt Channel entrance to a Blind Pass east of the bridge to a second huge pump located past the Gulf entrance to the Pass near Pine Avenue. That second giant pump pushes the sand about 500 feet south to Sanibel beaches in need of renourishment.

“Decades ago, when the current bridge was built connecting the two islands, the natural path of Blind Pass was considerably altered. Consequently, the pass periodically fills up with sand. Keeping the pass open and flushed is vital to water quality around both islands.

“In 2009, about 148,000 cubic yards of sand was dredged to reopen the pass, which had completely closed.

That dredging was followed by maintenance projects at the pass removing 63,300 cubic yards of sand in 2012 and 37,600 cubic yards of sand in 2013. Blind Pass almost completely closed in the spring of 2015, but storms cleared much of that sand.

“Prior to this current dredging project, designed to remove 120,000 cubic yards of sand, bathers and anglers could virtually walk across Blind Pass in spots. It also was largely blocked to boaters.

“Although portions of the beach will be closed for up to 500 feet near where active dredging equipment is being used and four parking places at Blind Pass Beach Park have been closed, the piping and heavy equipment have not greatly curbed use of the beach by bathers, shellers or anglers. Fishing from the bridge may intermittently be restricted during the project, and traffic is briefly halted when heavy equipment is being moved to and from a Santiva area beach near Pine Avenue. Beachgoers are urged to respect project signs and boundaries for their own safety and the safety of the crews.

“A major beneficiary of the dredging process is Sanibel, whose eroded Gulf beaches from Blind Pass to the northern edge of Bowman’s Beach are receiving sand removed from the pass.

“Half of the $1 million project is being funded by a grant obtained by the Florida Department of Environmental Protection, with the remainder coming from Lee County tourist-tax revenues.

“Lee County, Sanibel and Captiva officials are looking for a more lasting solution to keep the pass open and have commissioned a Blind Pass Inlet Management Study – a science-based study of the mechanics of the Pass.

“At a recent Captiva Community Panel, Rooker urged residents to attend a public meeting at 10 a.m. March 24 in the Pelican Room of the Sanibel Recreation Center, 3880 Sanibel-Captiva Road, for an update of the Inlet Management Study by engineers who have completed their data collection of model calibration phases of the Pass. “You will hear about different alternatives for keeping the Pass open,” she said, “and the public’s input will be important.” More information about the study can be found at: http://www.leegov.com/naturalresources/blind-pass-2016-inlet-management-plan-study

Irrigation Regulations

Island Water logoA good reminder in the Spring 2017 “IWA Pipeline” about the irrigation regulations that have been in effect since March 2010. Are you watering only on your days to water?

“The South Florida Water Management District manages water resources and sets the irrigation regulations for the 16-county region that stretches from Orlando to the Florida Keys. Homeowners on Sanibel are limited to watering three times per week and Captiva residents are limited to watering two times per week.

“Residents and businesses on Sanibel with an odd number address may water lawns and landscaping on Mondays, Wednesdays, and/or Saturdays between midnight and 10 a.m. and/or between 4 p.m. and midnight. Residents and businesses with an even address, no address, or those who water both even and odd addresses within the same zones may water Tuesdays, Thursdays, and/or Sundays between midnight and 10 a.m. and/or between 4 p.m. and midnight.

“Captiva residents and businesses are bound by the regulations for unincorporated Lee County and are restricted to watering two days per week. Residents and businesses with an odd address may water lawns and landscaping on Wednesdays and/or Saturdays between midnight and 9 a.m. and/or between 5 p.m. and midnight. Residents and businesses with an even address, no address, or those who water both even and odd addresses within the same zones may water on Thursdays and/or Sundays between midnight and 9 a.m. and/or between 5 p.m. and midnight.

‘There are some exceptions to the above regulations. Watering may be done at any time of using reclaimed water and hand watering is permitted any time if using a hose with an automatic shut-off nozzle. Additional watering up to 60 days is permitted for watering new landscaping.

“For additional information on irrigation times and water conservation you can visit the South Florida Water Management District website at https://www.sfwmd.gov. These irrigation times are also posted on our website at http://www.islandwater.com.

“One more note regarding irrigation. All new irrigation systems are required to have a rain sensor installed, which shuts off the sprinklers if rain is detected. If you have an older system that does not have a rain sensor, it would be wise to have one installed. Not only would you be conserving a precious resource by not sprinkling an already wet yard, you will also save money on your monthly water bill. Remember, in our tiered rate schedule, the more water you use per month, the higher the charge per thousand gallons of water.”

Another Picture-Perfect Friday on Sunny Sanibel

It is Susan and The SanibelSusan Team reporting that it was back to sunny days on-island this week. An absolutely picture-perfect one today, with temperatures in the mid-70’s. A little more Florida-winter type weather is expected on Sunday when a breezy cool front arrives with a few showers. Luckily those fronts don’t last long here and it again is expected to be sunny and back to the mid-70s by mid-week.

Island Real Estate Action

We still are not seeing lots of real estate activity which traditionally picks up each year sometime from mid-to-late January. Could be that the Saturday visitor turn-over this weekend will bring more action. The rental organizations tell us that will be the 1st week of the year with high-season occupancy. Even more check-ins are expected the following weekend as it gets closer to the 1st of the month.

sancap GO MLS logoYou will notice from the report below of the activity posted in the Sanibel & Captiva Multiple Listing Service that homes continue to be the predominate seller. Many price changes were posted this week too, with sellers recognizing that just 2+months of “high season” remain.

Over the last seven days on Sanibel, there were just two condo sales and two lot sales, but 12 home sales. One our new listing in Seagull Estates. During the same period, there were 17 price changes. That is a lot for a week mid-January.

San Cap LogoAt the Thursday Realtor® Caravan meeting yesterday, I gave a quick spiel about our 2017 Communications & Public Relations Committee kick-off meeting.

We discussed reaching out to local non-profits & becoming a year-‘round collection point for donated goods: things like non-perishable food items for the FISH pantry, old cell phones and hotel-sized toiletries for ACT, gently-used clothing for church charities in Immokalee; bedding for Bedz for Kidz which is part of Lee County’s Guardian ad Litem Foundation.

The committee is looking for more ways to be involved in the community in a cooperative way so are soliciting suggestions from local organizations and non-profits for what donation items they need and if here is a particular time of the year when most needed. Also, if there are small hands-on projects that could use a team of 5-10 volunteers to get them done.

With this year’s message “Together, We Make a Difference”, you will see monthly press releases about our members’ community involvement. Those members include not just Realtors® and their office staff, but also our affiliate members, including the bankers, inspectors, builders, decorators, contractors, title companies, attorneys, and other service business partners, who also are an important part of our organization.

Looking Back on Hurricane Season

Island Water logoInteresting tidbit noticed when I was catching up on my reading last weekend. The Winter 2016 issue of the “IWA Pipeline” (Island Water Association’s newsletter) said:

“Believe it or not, once more, the National Weather Service reports it has been over eleven years since a major hurricane has made landfall on the continental United States. Hermine was a Category 1 hurricane, and although Matthew was a Category 3 storm as it approached the Florida coast, technically it never made landfall, as the eye stayed just off the coast.”

Prospective buyers often ask about flooding and storms. What can we tell them? I often remind them that the island is mostly sand, so that water even after a heavy rain usually disperses quickly. We also can tell them about how the Sanibel River has a lock system and how water can be released, but that it’s rarely necessary. We also can say that weathermen tell us that we are in an area where there is probability of a hurricane every 100 years. Then the question is – do we start counting the 100 years from Hurricane Charley in 2004 or from the last time the island flooded from a hurricane – in the 1920’s? Either way, it’s just part of island life. From May to November, residents should have a hurricane plan and listen carefully to weather reports.

Sanibel Signs Water Quality Compact

“Much of Sanibel’s definitive white paper, Caloosahatchee Watershed Regional Water Management Issues, was adopted in the water quality compact of 164 communities and 19 counties.

“Sanibel was instrumental in the drafting of a new water quality compact that is the largest compact in Florida history, and on Tuesday, January 17, the City Council put its name to it.The City Council voted unanimously for a resolution pledging the city’s support in the Lake Okeechobee Regional Compact.

“The compact calls for cooperation among the 164 towns and cities and 19 counties in the Northern Everglades and Lake Okeechobee watershed. It calls for all to work together toward a comprehensive plan addressing environmental and economic challenges associated with discharges from Lake Okeechobee and to develop a joint strategic plan to successfully meet those challenges.

“Mayor Kevin Ruane and Sanibel Director of Natural Resources James Evans were instrumental in the drafting of the resolution through the Florida League of Cities. Evans is the author of Sanibel’s definitive white paper on water quality, Caloosahatchee Regional Water Management Issues. Ruane chaired the session where the resolution was adopted.

““It’s the largest compact the state of Florida has ever done,” Ruane said. “It’s a compact for all 164 cities and we are pleased that the resolution was adopted with the majority of the white paper in it.”

“The resolution calls for each local government to collaborate while also recognizing the individual needs of a diverse consortium of towns, cities and counties. It calls for a joint policy position to urge the U.S. Congress and the Florida Legislature to develop and fund the necessary plans to improve regional water conditions.

“The resolution states:

“The adopted Regional Action Plan shall, at a minimum, include the following components:

  1. A list of those local and regional projects and programs all parties to this compact mutually agree are critical to Everglades restoration, protection and improvement of local water supplies and water quality, enhancement of natural area and the economic vitality of our communities.

There was no local Realtor Caravan® Meeting this week, but the Sanibel & Captiva Islands Association of Realtors® yesterday announced presentation of a $4,500 check to the Sanibel-Captiva Conservation Foundation to help their efforts in providing guided tours of the Caloosahatchee and estuary to provide members of the public the opportunity to gain a personal experience and perspective on the river and the Everglades – its history, folklore, issues, and solutions. These are local RPAC (Realtor Political Action Committee) funds put to good use educating our community on the importance of a healthy ecosystem.

Several of our listings had showings this week too, with the activity posted in the Sanibel & Captiva Islands Multiple Listing Service below, after a couple of news items.

Market Update After 3rd Quarter 2016

statisticsNow that three-quarters of 2016 are over, it appears that Southwest Florida real estate sales this year will fall short of 2015. A recent article posted by an off-island “News-Press” Market Watch expert said:

  1. “Median home prices in Lee County are flat, down slightly in Collier County.
  2. The number of home sales in Lee County is down 17%,18% in Collier.
  3. Condo sales are down over 20%.
  4. $1 million+ market is down 13%.”

He also said “This is not a “lack of inventory” situation, as most non-sweet-spot segments are down or flat, except the $500-$1M range in Collier. That segment is up 9%. These numbers aren’t negative, they just “are”. SWFL is still the place to live, work or play.”

So how do Sanibel and Captiva sales compare in a similar analysis? The below statistics illustrate that though the islands officially are part of Lee County, in many ways, it is a totally different world here where there is less inventory and prices vary hugely. Compared to the same period last year (January 1 to October 20), this year:

  1. Median home prices on Sanibel are up 65%, up 84% on Captiva.
  2. The number of home sales on Sanibel is down 27%, but up 15% on Captiva.
  3. Condo sales are down over 15% on Sanibel, 50% on Captiva.
  4. $1 million+ market is down 10% on Sanibel, 28% on Captiva.

Going into season, there still are fewer condos and homes for sale on Sanibel than already have sold this year. The reverse is true on Captiva, where inventory is low, yet exceeds this year’s demand.

What’s Happening After “High Season”


SanibelSusan Realty from Periwinkle WayWinding up the second 2016 post-season week, The SanibelSusan Team already is itching for more action. We appreciate being able to drive down Periwinkle at the end of the workday without delays, but several days this week, even the phones have been too quiet.

More of our condo listings were vacant this week, for the first time in months, so my team has held a few open houses, but very few prospects visited. Even the island Realtor® Caravan meeting yesterday was lightly attended. Details on the week’s action in the Sanibel and Captiva Multiple Listing Service follow some news items below.

The below article posted in the “Santiva Chronicle” last Saturday resonates a similar tone about the market. It was written by Realtor® colleague Sarah Ashton who brought the buyer for our listing at Compass Point, scheduled to close soon. We kibitzed then about island sales.

Does The Market Seem Slow?

santiva chronicle“This is a recurring question about Island Real Estate that has been circulating for the last month or so.

“Both 2014 and 2015 saw a return to an active market and an absorption of a good deal of our outstanding inventory. At the end of 2015, we were at lows in inventory that rivaled historic for the Islands. With this reduced inventory and the economy moving into recovery, we faced the real possibility that 2016 was not only going to be another active year, but also one with some measurable price increases. We were expecting “A Pop.”

“With the first quarter of 2016 over, and these questions about the pace of the market expressed, let’s take a look at where we are, by the numbers.

“In 2015 there were 68 houses and 48 Condos that closed in the first quarter. In 2016 we have seen 44 house and 40 Condos closed. Thus far in 2016, we have experience a roughly 30% reduction in the number of closed sales as compared to the same timeframe in 2015 and prices have remained primarily flat over last year.

“Will this trend continue for the rest of 2016? Great question and a crystal ball might help. What we do know is that a confluence of El Nino warm weather produced the wettest January on record which affected the water quality. Combine that with the warmest winter in the Midwest and Northeast in many years. Combine both of these with an Early Easter and perhaps a bit of pre-presidential election jitters and we may just have created the perfect storm for a mini-pullback in our Real Estate market.

“These conditions will all pass. However it may be that until we get to the 4th quarter of 2016 we won’t experience the “Pop”.”

Here’s An Interesting Statistic

realtor logoAccording to National Association of Realtors® President Tom Salomone’s message in the March/April issue of “Realtor” magazine, “one in every 220 adults in the U.S. is a Realtor®.”

For years, some colleagues jokingly have said that when a person retires here – right after getting their Florida driver’s license, they also take the real estate exam. With this national statistic, it must be happening elsewhere too.

The Upside to a Changing Market

Florida Realtors logoAs described in the April 2016 issue of “Florida Realtor®”, there has been a change in the international buyers and sellers doing business in Florida. As the article says “the international market is changing, but there are still opportunities….”

“International buyers and sellers accounted for 11% of the state’s residential transactions in 2015. The largest countries for global buyers were Canada, the U.K., Germany, France, China, Argentina, Brazil, Columbia, and Venezuela….Because global buyers tend to buy higher-priced homes and condominiums, they had a 24% share of total residential sales volume.

“International buyers love Florida’s real estate market. It’s an attractive vacation destination with convenient air access from Canada, Europe, and Latin America…But Florida’s appeal to those buyers is affected by many factors, particularly changes in foreign exchange rates that can make Florida properties more expensive or reduce their cost. The recent strengthening of the U.S. dollar has slowed the pace of foreign purchases by Canadians, Europeans and residents of some Latin American countries.

“Immigration and visa restrictions can be problematic for potential buyers, who also pay close attention to U.S. attitudes toward immigrant groups….Here is a closer look at Florida’s most important global markets.

canada-flagCANADA –In 2015, Canadians were only 11% of international buyers, a steep drop from 32% the prior year, primarily because of a less favorable exchange rate. Canadian buyers in all income segments like buying homes in the Sunshine State. Traditionally, French-speaking Canadians from Quebec have bought along the I-95 corridor, while English speakers from Ontario and the western provinces have gravitated to Central Florida and the Gulf Coast….

UK FlagUNITED KINGDOM – U.K. buyers were 5% of the state’s international market in 2015, down from 7% in 2014 and 15% in 2010. A stronger U.S. dollar has led to a decline in sales to buyers from the U.K. and other northern European countries…That trend had had a greater impact on U.K. buyers investing in rental properties…But lifestyle buyers who want to spend six months in Florida are still purchasing here…U.K. buyers traditionally favor Central Florida and often buy relatively inexpensive vacation homes near Orlando’s theme parks….

Germany flagGERMANY – German buyers were 2% of the state’s international market in 2015, down from 5% in the prior year…In Germany, Belgium, Austria, and Switzerland, a real estate transaction is not valid until a notary signs the document in the presence of both parties….” So some education is involved here.

french-flag-largeFRANCE – French buyers were 3% of the state’s international market in 2015, unchanged from 2014. In the past decade, French buyers and investors have significantly increased their presence in the Florida market…When property values dropped during 2008-09, many European investors saw an opportunity here…Now, South Florida has a significant number of French, Italian, Spanish, Belgian and Swiss owners…. French buyers tend to purchase in Miami-Dade, Broward and Palm Beach Counties….French buyers like Europeans are looking for residences with special features such as landscaping or interior design…They do not want cookie-cutter houses or condos…The quality of construction and the details of the architecture are very important.

china flagCHINA – Chinese buyers have increased their presence in recent years and now constitute 4% of international buyers, up from 1% in 2011. In the past few years, South Florida has attracted a growing number of buyers from China, as well as Korea, Vietnam, India, the Philippines and other Asian countries….In some cases,… parents will buy a home close to a campus, planning to hold it for four years or longer….Access to quality education and clean air are top priorities for Chinese buyers….

Brazil flagBRAZIL – Brazilian buyers were 9% of the state’s international market in 2015, up from 6% in 2014. For the past five years, Brazil has been one of Florida’s strongest international markets. Many affluent buyers purchased new condominiums and resales in the Miami market in all-cash transactions for personal use or investment. But the inflow of buyers from South America’s largest economy has been slowing over the past year, due to an economic recession, a political corruption scandal and the devaluation of the Brazilian real, which has fallen to record lows compared with the U.S. dollar.

Argentina flagARGENTINA – Argentine buyers were 7% of the state’s international market in 2015, up from 3% in 2014….

Flag_of_ColombiaCOLUMBIA – Columbian buyers were 7% of the state’s international market in 2015, up from 4% in 2014….

venezuela flagVENEZUELA – Venezuelan buyers were 18% of the state’s international market in 2015, up from 3% in 2014…. As Venezuela is one of the world’s major oil producers, its economy has been hit hard by the 2015 downturn in oil prices…and their recession is expected to deepen this year…”

What Does This Mean for the Sanibel/Captiva Market? And SanibelSusan Realty Associates?

Narrowing Florida’s recent international business to just the area of Sanibel and Captiva, European countries continue to dominate the islands’ buyer market. Most recent transactions with Canadians have been with them selling, usually because of the exchange rate. There is little business here with residents of Asia and South/Central America, but that could and, likely will, change.

Comprised of mostly real estate professionals with internationally-recognized designations, through ProxioPro, I have personal connections with offers to pay referral fees to over 450 world-wide real estate professionals who have reached out to me indicating that they have buyers interested in Sanibel and Captiva.

My most recent ProxioPro out-of-country referral requests came from France and Canada, followed by Brazil, Greece, the Netherlands, Costa Rica, and the Dominican Republic. In-country requests have come mostly from agents on the other coast of Florida, particularly Miami. California and Texas are the two states that also have brought many recent requests.

juwai logoJuwai.com – This summer, my plan is to get a company profile and our listings posted on Juwai which is an international property portal for Chinese-speaking buyers looking to purchase property outside their country. On a national level, last year Chinese buyers surpassed Canadians in U.S. purchases, though most of these buys were on the west coast or in New York. Like most everywhere today, the Chinese economy is settling into a new normal. Considering that China has never been as large or powerful as it is now, my guess is that investment property here will appeal to them – if only they knew about it. Many in China are seeking not only safe monetary harbors, but also better educational opportunities for their children, so you can be sure that I will be touting the success of nearby Florida Gulf Coast University as well as other schooling opportunities here.

Why More Americans Are Heading South

From a recent posting on “Daily Real Estate News”:

RealtyTracLogo_166x32“A rising number of Americans are heading to southern states, lured by a combination of warmer weather, affordable housing, lower taxes, and less congested cities, according to a new report published by RealtyTrac called “The Next Great Migration of ‘Housing Refugees’ On the Move.”

“New census data confirm the findings. Since 2014 alone, more than 1.4 million people have moved to the Sun Belt, mostly from the Northeast and Midwest, according to Census Bureau data.

“That marks a stark difference to previous mobility trends. For more than a century, Americans predominantly headed west to cities such as Los Angeles, San Francisco, San Diego, and Seattle. But lately, that migration trend is taking a turn south.

““This 20th century movement west, which has dominated American demographic patterns for decades, may now be reversing itself in the 21st century as rising housing costs, stagnant job creation, restrictive land-use laws and no-tax states, pull Californians, Midwesterners and Northeasterners eastward and southward to less costly regions and more business-friendly states in the Sun Belt,” RealtyTrac’s report notes.

“Americans are fleeing pricey coastal states like California and New York and heading to states considered more affordable, such as Texas, Florida, and the Carolinas, according to a recent United Van Lines report.

During the Great Recession, populations in the Sun Belt saw a decline, but now analysts are saying there’s a renewed “Snow Belt–to–Sun Belt migration pattern,” notes William H. Frey, a demographer and senior fellow at The Brookings Institution in Washington, D.C.

“Florida is especially feeling a heat wave of new residents. For the first time in nearly a decade, Florida added more people than California between July 2014 and July 2015, according to Census Bureau data. That helped Florida emerge as the third most populous U.S. state, jumping ahead of New York (and following California and Texas).”

Summer In Full Swing on Sanibel & Captiva Islands


It’s a little overcast this afternoon on Sanibel and Captiva Islands, but as Floridians know, if we wait a minute in the summer, the sun will be out. If that is late day, it usually results in a beautiful sunset.

Below are a few news items, followed by the activity posted in the Sanibel and Captiva Multiple Listing Service this week.

Progress on Sanibel’s Civic Core

During Tuesday’s City Council Meeting, the most recent Sanibel Civic Core conceptual plan, which has been in the works for over a year, was presented. The architect has been meeting with city officials and stakeholders associated with the project – i.e. BIG ARTS, Sanibel Community Association, Sanibel Historical Museum and Village, and The Center 4 Life.

The plan would consolidate the island’s most frequented facilities on a 25-acre site adjacent to City Hall. The latest version of the project layout includes a hub of five buildings – a performance hall, theater, gallery, Lifelong Learning facility, and Center 4 Life – surrounding a central courtyard with stage. It would be elevated between a large community green to the west and parking to the east, surrounded by a shared-use path and including both stairs, access ramps and public seating and gathering spaces.

According to an article in today’s “Island Sun”, “the community green would be located to the north of a smaller green space (where the Herb Strauss Theater is currently located) and would include two pavilions and public restrooms, which would allow two events to be held simultaneously.”

69 Acres of Mangroves Protected on Captiva

Good news reported this week in the “Island Sun” about the end of long-time wrangling with developers of South Seas Plantation and those opposing the destruction of mangrove wetlands in a basin area of Captiva. This case went all the way to the “U.S. Department of Justice who defended the case on behalf of the United States in May 2014…Following months of negotiations, a final settlement has been reached and publicly filed with the court…The U.S. Government, in order to avoid further litigation expense, agreed to compensate PDL (Plantation Development LTD) in the amount of $2.4 million (plus interest and legal costs) in exchange for PDL’s agreement to transfer 69 acres, comprising the potential Harbour Pointe development site, to the United States….The property has now been transferred.

It will be managed as part of the National Wildlife Refuge System, JN Ding Darling National Wildlife Refuge. Kudos to the Captiva Civic Association, SCCF (Sanibel-Captiva Conservation Foundation), and the Conservancy of Southwest Florida for not giving up!

Here’s Where Buyers Are Paying All-Cash

“While the number of all-cash transactions is dropping nationwide, a few pockets across the country are still seeing a large share of buyers paying all-cash for their home purchase.

“Nationwide, the number of all-cash sales making up transactions has plummeted since peaking in January 2011 when cash transactions made up 46.5% of total home sales nationally. Now, that percentage has dropped to 33.7% of total home sales, according to CoreLogic’s cash sales report.

“The year-over-year share of cash sales has fallen each month since January 2013. Despite the drops, cash sales still remain elevated by historical standards. Prior to the housing crisis, cash sales made up about 25% of home sales, according to CoreLogic. If cash sales continue to fall at the most recent pace, the share should hit 25% by mid-2017.

“The largest number of cash sales are through real estate-owned sales, with nearly 57% of cash sales being from REOs. Resales followed with the highest cash share at 33%, followed by short sales at 30% and newly constructed homes at 15%.

  • Florida: 51.4% of transactions were from cash sales
  • Alabama: 48.5%
  • West Virginia: 48.3%
  • New York: 45.4%
  • Kentucky: 41.4%.

“By metro level, the following cities had the largest number of cash sales:

  • West Palm Beach-Boca Raton-Delray Beach, Fla.: 59.1%
  • North Port-Sarasota-Bradenton, Fla.: 58.5%
  • Cape Coral-Fort Myers, Fla.: 58.1% (SanibelSusan note: it’s much higher on Sanibel/Captiva)
  • Detroit-Dearborn-Livonia, Mich.: 58%.
  • Fort Lauderdale-Pompano Beach-Deerfield Beach, Fla.: 56.9%.

“Meanwhile, Syracuse, N.Y., had the lowest share of cash sales at 11%, according to CoreLogic.”

Sanibel Draft Budget Presented for FY 2015-16

Sanibelcityseal logoThe initial draft FY 2015-16 budget was presented to City Council this week. Council unanimously approved a proposed operating millage rate of 1.939 mills, identical to last year’s approved and adopted rolled-back rate. The first budget public hearing will be on Saturday, September 19 at 9 a.m. when they will discuss and adopt the tentative millage rate and budget. The second and final budget hearing will be on Tuesday, September 22 at 5:01 p.m.

The August-September 2015 “SCCF Member Update” received this week included statistics on sea turtle nesting, including the byline “So Far, An Amazing Season”. Here are a few more details as penned by Kelly Sloan, SCCF Sea Turtle Coordinator:

“Historically, the East End of Sanibel (Lighthouse Beach to Tarpon Bay Road) has been the lowest density nesting beach survey by SCCF’s Sea Turtle Program. An average of 38 nests per year have been laid on the East End between 1996 and 2013.

“2014 was a record year for the East End, with 110 nests laid on the five-mile stretch of beach. This year, in mid-June, the East End had already documented 70 nests. Loggerheads (Caretta caretta) typically nest from May-August, so we anticipate many more to come!

“Mid-season nest counts also suggest that the West End and Captiva are on track for an above-average nesting season.

“We are also excited to report that green sea turtles (Chelonia mydas) have returned to nest on our beaches in 2015. You may remember that a record 23 green nests were laid on Sanibel and Captiva in 2013. Sea turtles nest at intervals of about every two years, so another pulse of green nests in 2015 coincides with their biennial nesting pattern.

“But it gets even better – early in the 2015 nesting season, a leatherback (Dermochelys corriacea) nest was laid on Sanibel! Leatherbacks do not commonly nest on the west coast of Florida. The largest nesting population for Atlantic loggerheads is French Guiana, and there are also nesting colonies in the Caribbean and the east coast of Florida. The only other leatherback nest documented on Sanibel was laid in 2009.

“Leatherbacks are the largest species of sea turtle, weighting up to 2,000 pounds. They can dive deeper than any other sea turtle (up to 3,900 feet) and they migrate extreme distances. We are thrilled to have the opportunity to protect a nest laid by this remarkable species!

“Throughout the nesting season, volunteers and staff have been screening nests to protect the eggs from predation by coyotes. As we enter the hatching season, the City of Sanibel and SCCF will partner to promote the “lights out” message in an effort to reduce hatchling disorientation. A grant award from the Sea Turtle Conservancy, funded by the specialty sea turtle license plate (SanibelSusan has one of those), has provided support for educational materials to remind beachgoers and beachfront property owners…Stay tuned for the final nesting and hatching statistics. You can find the current nesting stats at seaturtle.org, accessible from the sea turtle pages at www.scc.org .”
